Throughout the course we have seen examples of where the criminal justice system has created unjust outcomes, resulted in miscarriages of justice, and reproduced structural inequalities. In this assessment you will undertake a real-life case study that exemplifies these issues. You will analyse how the criminal justice system contributed to the injustice or inequality and you will consider how alternative justice mechanisms could have avoided the injustice, or could be used to remedy the injustice.

You must choose one of the following case studies to analyse:

• Aboriginal Deaths in Custody – TJ Denis

• Mental Health and Miscarriages of Justice – Andrew Mallard

• Injustice and Victim/Survivors in Trials – Bruce Lehrmann case

In analysing the case, you must answer the following question:

• How did the criminal justice system contribute to the injustice AND how could the injustice have been avoided or remedied?
